In three issues, DeWayne Stewart appeals the trial court's grant of summary judgment in favor of Sanmina Texas L.P., Sanmina-SCI Corporation and John R. Sitton on Stewart's claims for age discrimination and retaliation in violation of chapter 21 of the Texas Labor Code, and breach of contract or quantum meruit for failure to pay certain commissions and expenses. Because we conclude that Stewart has produced evidence raising an issue of fact respecting his claims against the Sanmina corporate entities for age discrimination and breach of contract for failure to pay certain past commissions, we reverse the summary judgment as to those claims and remand them to the trial court for further proceedings. We affirm summary judgment as to the remaining claims.
